This Terms of Service governs your use of Accreditation software and services. This
Terms of Service controls, except where other agreements expressly state they apply.
1. Accreditation Services
Accreditation wants to give you the fastest and most comprehensive accreditation
tracking and reporting system out there. As such, Accreditation offers you the limited
use of its proprietary software, methodology, and services to track your services.
Specifically, Accreditation software and services are designed to:
Profile
First we create a custom profile for your surgery center with number of ORs, type of
specialties, MediCare participation, and the accreditation agency you use (AAASF,
AAASC, Joint Commission).
Capture
Using our proprietary software enabled on an internet enabled device, we capture your
required tests and data.
Analysis
Accreditation software recognizes any value out of compliance or any missing data
elements and alerts you immediately. Your reports are set for compliance with your
standards. Note, Accreditation?s services are only as good as the data imputed, users
should still make sure they are imputing truthful and accurate data.
Reporting
All imputed data elements are tracked and recorded by date. This data is available 24/7
through our secure website. When appropriate, reports are sent directly to Governing
Boards for immediate review.
Inspection
Accreditation allows you to show relevant data and your account to licensed inspectors
that are part of recognized governing boards.
Not a Medical Device
Note: Although Accreditation provides sophisticated software and services for the
medical industry, Accreditation is not, nor holds itself out to be a medical device.
2. Permissions you give Accreditation
To provide you with certain services, there are certain permissions you must grant
Accreditation. By using our site, services, or any other products you agree to grant
Accreditation the following:
Permission to use content and data you input into our software.
We understand that information and data you input is of a private nature. However, we
necessarily must store and use such data in order for you to use our services.
Additionally, we may be required to share such information with third parties as
required by regulation and to report compliance with regulators. By using our software,
you agree Accreditation may view the data you give it, manipulate such data, and share
data with third parties.
Permission to update our software at any time.
Though our software is the best in the industry, it is not perfect. At times we may need
to update our software. Accreditation strives to give as much notice as possible before an
update, but in order for our services to work properly, we may need to update our
software immediately without notice. As such, you agree to give Accreditation
permission to update our software on any device and account you are using at any time.
2. Additional Provisions
Use and Security of Your Account
You agree that you will take reasonable measures to ensure the security of your account.
This includes using passwords or other security measures to protect hardware you run
Accreditation software on. Additionally, you agree not to share your account with others
not licensed to use the account. Certain regulators may be given access to your account
for a limited time in order to check compliance. If your account is compromised you
agree to notify Accreditation immediately. Additionally, Accreditation requires a
username and password to set up an account, as well as billing information. The
information you provide us must be accurate and true.
Terms Updates
Accreditation works constantly to make sure its software and services are up to date
with regulator requirements. Thus, there may be times when Accreditation must update
this terms of service and other agreements with little to no notice. Accreditation strives
to give as much notice as possible when changes need to be made to these terms. In the
event you disagree to new terms provided by Accreditation you may delete or terminate
your account.
Compliance with Regulatory Requirements
Accreditation strives to provide the most updated and advanced methods of tracking
accreditation. Nevertheless, with the myriad of regulations and ever increasing amount
of regulatory bodies, there may be times when Accreditation software and services are
not in sync with regulatory requirements. By agreeing to use any Accreditation software
or services, you represent that you are familiar with the regulations and record keeping
required to maintain accreditation with desired organizations. You further represent
that you are using Accreditation only as a supplement for such record keeping and not
as the primary means for keeping with compliance.
Suspension or Termination of Account
If you fail to comply with any of the terms of this agreement, or other agreements with
Accreditation your account may be terminated. Accreditation is not responsible for any
data loss or confusion the suspension of such an account may cause.
Reverse Engineering/Competitive Practices
Accreditation offers you its software and services for the sole purpose of using them in a
medical setting. By agreeing to use any of our services, you agree you are not using the
services, at least in part, to reverse engineer or duplicate any portion of our software or
processes. You agree not to copy or infringe any of our intellectual property, including
copyright, tradesecret, patent pending subject matter, and trademarks. You also agree
that you are on notice of all Accreditation intellectual property rights. In the event you
do choose to violate this provision you agree to pay Accreditation attorney fees and costs
for Accreditation to enforce its intellectual property rights against you in State Court,
Federal Court or arbitration proceedings.
No Legal or Medical Advice Given
Accreditation software and services does not provide legal or medical advice. Any
information or recommendations provided by Accreditation or its representatives in
connection with your use of its software and services is for supplemental record keeping
purposes only and you are responsible for investigating such recommendations and
making the final determination as to whether such recommendations are appropriate
for the care you provide. Accreditation is not responsible for any decisions made by you
with respect to your services rendered to others, whether or not such decisions are
related to the services provided by Accreditation.
Other than the personally identifiable information that you provide upon registering as
a user of this website, no personally identifiable information shall be provided to us in
connection with your use of Accreditation software and services, including any
information related to your patients or employees. You are solely responsible for
complying with this requirement and Accreditation is not responsible for anything
arising from or related to any such disclosure to us by you, whether such disclosure is
intentional or unintentional.
Limits on Liability
Our software and services are provided ?as is? and Accreditation makes no guarantees
that they will be entirely accurate, error free, or that they will function without
disruptions. To the extent permitted by law Accreditation DISCLAIMS ALL
WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED
WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
TITLE, AND NONINFRINGEMENT. Accreditation cannot predict what issues or
situations may arise with our software and services. As such, our liability shall be limited
to the fullest extent permitted by law. Under no circumstances will Accreditation be
liable to you for any lost profits, revenues, information, or data, or consequential,
special, indirect, exemplary, punitive, or incidental damages arising out of or related to
these terms of services or other agreements between You and Accreditation. Our
aggregate liability arising out of or relating to these terms of service, other agreements
or Accreditation software and services will not exceed the greater of $100 or the amount
you have paid us in the past six months.
Disputes
For any claim, cause of action, or dispute you have against Accreditation regarding this
terms of service agreement you agree that such a dispute will be resolved in the U.S.
District Court for the Central District of California or a state court located in Ventura
County. The laws of the State of California will govern these terms and any claim,
without regard for conflict of law provisions.
